Terms of Use

The rules for using upeak.io and taking part in the beta. Short, because the apps are not medical devices.

The agreement

These terms govern your use of the upeak website (upeak.io) and your participation in the upeak beta programme. By using the site or joining the waitlist you agree to them. If you do not agree, do not use the site. upeak is operated by upeak; contact hello@upeak.io.

Using the site

You may browse the site and share links to it freely. You may not scrape it at scale, attempt to break it, probe it for vulnerabilities without telling us first, submit the waitlist form with someone else's email, or use it to send spam. Automated access for search indexing and AI answer engines is welcome; our llms.txt and sitemap exist for that.

The waitlist and the beta

  • Joining the waitlist creates no obligation on either side. It is a request for access, not a purchase.
  • We invite people in the order and priority we choose, guided by the apps they said they wanted. We cannot promise a date, a slot or a particular app.
  • If an app has a paid tier, we will say so before charging anyone anything.
  • Beta software is unfinished by definition. It may change, break, lose data or be withdrawn at any time. Keep your own copies of anything you care about.
  • We may ask for feedback. Anything you tell us about the apps can be used to improve them, without payment or attribution.
  • We can end your beta access, and you can leave, at any time. Leaving triggers deletion of your account data as described in the Privacy Policy.

Not medical advice

PeakU, PeakVital and PeakBeat are fitness tools, not medical devices. Peak Scores, readiness calls, fitness ages, training plans, heart-rate zones and every other number or recommendation they produce are estimates derived from consumer wearables and simple field tests. They are not a diagnosis, a treatment or a substitute for a doctor. Do not begin, change or stop a training, fasting or nutrition regime on the strength of an app without talking to a qualified professional, especially if you have a medical condition, are pregnant, or are new to exercise. Stop and seek help if you feel unwell. You are responsible for your own safety during any activity the apps suggest.

PeakLook sends on your behalf

PeakLook drafts and, when you enrol a contact in a sequence, sends email from your own account on your instruction. You are the sender. You are responsible for the content, for having a lawful basis to contact each recipient, and for complying with anti-spam and marketing laws where you and your recipients are. Do not use it for unsolicited bulk mail. We built stop-on-reply and send locks to keep you out of trouble; they do not replace your judgement.

Ownership

The site, the apps, the upeak name and marks, the designs and the code are ours or our licensors'. These terms give you a personal, non-transferable licence to use the site and any beta app for its intended purpose, and nothing else. You keep every right to your own data and content; you give us only the licence we need to run the service for you.

Disclaimers and liability

The site and the beta apps are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. To the fullest extent the law allows, upeak will not be liable for any indirect, incidental, special or consequential loss, or for lost data, lost profits or injury arising from use of the site or a beta app, and our total liability for anything arising from these terms will not exceed the amount you paid us, which during the beta is nothing. Nothing in these terms limits liability that cannot be limited by law.

Governing law

These terms are governed by the laws of the State of Israel, and the courts of Tel Aviv have exclusive jurisdiction, except that if you are a consumer in the EU, UK or another jurisdiction whose law gives you mandatory protection, you keep it.

Changes

We may update these terms as the beta evolves. The date at the top shows the current version. Continued use after a change means you accept it; if you do not, stop using the site and ask us to remove you from the waitlist.
